Terms of Service

These Terms govern the use of TabToCart (the "Service"), provided by Maxime Ragionieri, Entrepreneur individuel (EI), trading as TabToCart ("we"). The Service is intended for professional customers (businesses, agencies, freelancers). By creating an account you confirm that you act for professional purposes.

1. The Service

TabToCart runs automated accessibility tests on publicly accessible websites, monitors them over time, detects regressions, sends alerts and generates reports. The Service is an automated detection and monitoring tool. It does not certify, guarantee or establish conformance with WCAG, EN 301 549, the European Accessibility Act, national laws or any other standard or regulation. Automated testing cannot assess every accessibility requirement. Results, scores and priorities are indicative.

2. Authorised use

You may only scan or monitor websites that you own or that you are authorised to test (for example on behalf of a client). You must not use the Service to overload, attack or probe third-party systems. Our Acceptable Use Policy applies.

3. Account

You are responsible for your credentials and for all activity on your account. You must provide accurate information.

4. Plans, trial, payment

Paid plans are billed in advance, monthly or yearly, through Stripe. A free trial may be offered once per customer. Prices exclude VAT, which is added where applicable. Subscriptions renew automatically until cancelled. You can cancel at any time from the billing page; cancellation takes effect at the end of the current period and no refund is due for the period started, except where required by law. If a payment fails and remains unpaid after automatic retries, the Service is downgraded to the Free plan until payment.

5. Availability

We aim for high availability but provide the Service "as is", without guaranteed uptime. Scans may fail or be incomplete because of the target site's behaviour, bot protection, network conditions or changes on the target site.

6. Your data and client data

You keep all rights to your data. You grant us the rights necessary to operate the Service. Where we process personal data on your behalf, our Data Processing Agreement applies.

7. Liability

To the maximum extent permitted by law, our total liability for any claim is limited to the amounts you paid in the 12 months preceding the event. We are not liable for indirect losses (loss of revenue, business, data, or claims from third parties), nor for decisions taken on the basis of reports, nor for any sanction or claim relating to the accessibility or legal compliance of your or your clients' websites.

8. Suspension

We may suspend accounts that breach these Terms, create security risks or are used abusively.

9. Changes

We may update these Terms. Material changes are notified by email at least 30 days in advance.

10. Law and jurisdiction

These Terms are governed by French law. Any dispute between professionals falls under the exclusive jurisdiction of the courts of Le Mans, France.
